Why Have Construction Defect Claims Increased?

The early 2000s saw the beginnng of the largest housing construction boom ever.  According to the U.S. Census Bureau, between the year 2000 and 2005 annual residential building permits issued rose from 1,592,300 to a record 2,155,300.

During this time, the number of building contractors and workers in the construction industry also swelled. And so, too, did the number of construction defect claims.  The reason?  Too many unskilled workers were drawn into construction to fill the incredible demand for new homes. Combined with contractors who took on too much work, this led to a wide range of construction mistakes contributing to leaky roofs, cracked foundations, and many other problems.

Though some builders are owning up to their mistakes and correcting problems for their customers, far too many others are trying to escape massive liability for multiple defects that were repeated in hundreds of homes in tracts and multi-family developments. Thus sprang up a cottage industry of attorneys and expert witnesses to help homeowners and homeowner associations get their homes repaired.
